— VICKSBURG — David E. Selby of Union, N.J., told police apparently fell asleep on June 17, just before his pickup truck drifted off Route 45 then struck and killed Keith R. Wertz, who was standing in a driveway.

State police at Milton have now filed involuntary manslaughter, careless driving and related charges against the 32-year-old New Jersey man.

According to court documents, Selby was driving east on Route 45 at about 6 p.m. when his Dodge Ram left the road, traveled into a grass area then struck Wertz. There were no indications that the driver took any evasive actions prior to striking Wertz, 53, of New Columbia, according to court papers.

Selby told police that he was traveling from a residence in Millmont back to New Jersey with his four children that day, but that he was tired and believes he may have fallen asleep just prior to the accident. Blood tests showed no indications that Selby was under the influence of alcohol or medications.

Police wrote in court documents that the charges are justified because Selby was noticebably fatigued and failed to take actions to correct the situation.

In addition to involuntary manslaughter and careless driving, he has been charged with failure to keep his vehicle in his lane of travel an failure to have automobile insurance coverage.
