MIDDLEBURG — A Snyder County judge today upheld a Selinsgrove Zoning Hearing Board decision denying a borough resident’s request for a variance to build a tree house.
“Getting a variance is very, very difficult. The reality is we have to follow the law and there is no basis for granting a variance,” said Senior Judge Louise O. Knight as she denied resident John “J.C.” Carlson’s appeal.
Carlson had begun building a tree house on his front lawn at 701 W. Spruce St. for his daughter, Samantha, last spring and was ordered to stop because it violated the borough ordinance requiring a 35-foot setback.
“I don’t like it,” the 11-year-old said of the judge’s decision.
The partially built wooden treehouse will soon be dismantled, but Samantha said she isn’t giving up on having a playhouse.
“We’ll put it on wheels,” she said.
