Panel: Ex-Valley prisoner stomped cellmate to death

WILLIAMSPORT — WILLIAMSPORT — While an inmate at the U.S. Penitentiary at Lewisburg,

Javier Oswaldo Jovel-Aguilar punched and kicked cellmate Arnold Smith to death, according to a grand jury indictment Thursday.

A U.S. Middle District panel accuses the 36-year-old of the June 1, 2010, murder.

After Smith was handcuffed from behind through an opening in the cell door in preparation for going to the recreation area, Jovel-Aguilar punched him in the face, causing him to fall face-down on the floor, the indictment alleges.

Jovel-Aguilar then kicked and stomped on Smith’s head, ignoring demands of a corrections officer to stop while he waited for assistance, according to the indictment.

When other guards arrived, the indictment states Jovel-Aguilar allowed them to handcuff him through the door opening, but he allegedly kicked Smith repeatedly in the head before he could be removed from the cell.

Jovel-Aguilar is now incarcerated at the Lompoc prison in California, according to the U.S. Bureau of Prisons website.

Meanwhile, two federal inmates have been charged with assault with intent to commit murder from a 2012 incident at the Allenwood Federal Penitentiary.

Lance Lamont Gatling, 39, and Andre Miller, 43, were indicted Thursday by a U.S. Middle District grand jury on the attempted murder count and charges of assault with a dangerous weapon and assault resulting in serious bodily injury.

Gatling also is charged with possession of contraband, a homemade sharpened piece of metal.

The charges allege that on Jan. 19, 2012, another inmate, Darnell Dyson, was stabbed repeatedly with the homemade weapon.
