Misidentified fisherman cleared of charges

DANVILLE — It was a case of mistaken identity.

Kyle Foster, 35, of Bloomsburg, said he was working when he allegedly was fishing illegally March 10 in Mahoning Creek in Valley Township.

He produced paperwork to prove he was at work and presented it Wednesday to Montour County District Judge Marvin Shrawder.

The incident occurred at 3:15 p.m. and he worked until 3:30 p.m. that day.

Foster said he believed his ex-girlfriend’s boyfriend was fishing there at the time. He said the vehicle at the scene is in his name and the name of his ex-girlfriend.

A passerby saw a man fishing and recorded the license plate. Steven Boughter, waterways conservation officer, obtained the names of the vehicle owners, a photo of Foster and showed it to the passerby. Boughter is with the Pennsylvania Fish and Boat Commission.

“I don’t fish. I’m a vegetarian,” Foster told Shrawder.

Boughter, who filed the summary citation against Foster, withdrew the citation.
