ATM theft defendant wants attorney

DANVILLE — A Danville woman who pleaded guilty to stealing more than $80,000 from the ATM where she worked now wants to be represented by an attorney.

Tracy Jane Truesell, 51, of 712 E, Front St., told Montour County Judge Gary Norton on Monday she preferred to be represented by a lawyer.

As a result, Norton postponed her sentencing which was to occur Monday.

Montour County District Attorney Rebecca Warren said Truesell repeatedly had been told to get a lawyer.

“It has been a year since the charges were filed,” Warren said.

Truesell admitted in May to stealing $84,047 from the ATM she was supposed to fill daily at the Valley Township store where she worked.

At that time, she told Norton she couldn’t afford an attorney and didn’t qualify for representation by a public defender.

She told Norton Monday her husband was the only one working.

“You have to free up money to get a lawyer,” the judge told her, “and you have to have this all done in one month.”

Truesell’s sentencing is scheduled for July 9, “same bat time, same bat channel,” Norton told her.

He said no more continuances will be granted in her case.

Truesell, who hasn’t been arrested before, faces a standard sentence range of nine months to 16 months in jail.

Truesell, who is free on bail, was charged with stealing money from her employer from February 2010 through March 2013.

State police at Milton charged Truesell with theft by unlawful taking or disposition, theft by deception, receiving stolen property, theft by failure to make required disposition of funds received, two counts of forgery, tampering with records and misapplication of entrusted property.

Truesell was responsible for receipts and records of daily money collected and receipts and records of money deposited in the ATM at the Fuel Station at 5 McCracken Road in Valley Township. Leighow Oil Co. owns the business which also houses a Subway restaurant.
